NILLUMBIK: Tribunal sets aside Council decision


Victorian Civil and Adminstrative Tribunal Member Alison Glynn has set a Nillumbik Shire Council decision, and allowed a planning permit decision favourable to Research land owner Rowan Murphy.

Mr Murphy sought to re-subdivide a three-lot property at 1622 and 1630 Main Rd, totalling 3.07 hectares, and one dwelling on two of the lots.

Ms Glynn visited the site and surrounds after Nillumbik Shire Council refused to grant a planning permit for the re-subdivision and altered access. The Council argued that the re-subdivision was not permitted in the Rural Conservation Zone.

Biodiversity and arborist reports were submitted in regard to removing some indigenous vegetation on the property.
